Terms of Service

1. About these terms

These Terms of Service (“Terms”) govern your use of the Offleash platform, operated by CEDR Consulting Pty Ltd dba Offleash (ABN 90 670 532 377) of 5 Repton Road, Malvern East VIC 3145, Australia (“we”, “us”, “our”). The Offleash platform is available at getoffleash.com.au and associated applications (the “Service”).

By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

We may update these Terms from time to time. If we make material changes, we will notify you via in-app notification at least 14 days before the changes take effect. Your continued use of the Service after the effective date of any update constitutes your acceptance of the revised Terms. If you do not accept an update, you may delete your account before it takes effect.

2. Who can use Offleash

To create an account on Offleash, you must:

  • Be at least 16 years of age. Offleash is an age-restricted social media platform for the purposes of the Online Safety Amendment (Social Media Minimum Age) Act 2024 (Cth). We take reasonable steps to prevent users under 16 from creating or maintaining accounts.
  • Provide accurate, truthful, and current information when creating your account and dog profiles
  • Have the legal capacity to enter into a binding agreement in your jurisdiction

You may only hold one account per person. You must not create an account on behalf of another person without their explicit consent.

3. Your account

You are responsible for:

  • Maintaining the security of your account credentials
  • All activity that occurs under your account
  • Keeping your account information accurate and up to date

Do not share your password with others. Notify us immediately at hello@off-leash.app if you suspect any unauthorised access to your account.

We may suspend or terminate your account if we have reason to believe it has been compromised, is being used fraudulently, or is in breach of these Terms.

4. Dog profiles and multi-human accounts

Creating a dog profile

You may create profiles for dogs you own, care for, or are responsible for. You warrant that any information you enter about a dog — including health information, vaccination status, and microchip details — is accurate to the best of your knowledge. You must have the consent of any person whose contact details you enter as an emergency contact.

Linking multiple humans to a dog profile

Offleash allows more than one human account to be linked to the same dog profile — for example, family members or others who share responsibility for a dog. The person who creates the dog profile is designated the primary human. Linked humans may check in the dog, post photos, and receive dog DMs, but the primary human controls the dog profile and may add or remove linked humans at any time.

Disputes between linked humans

Offleash does not adjudicate disputes between linked humans regarding a dog profile. If a dispute arises — for example, between separated owners — the primary human retains control of the profile. Offleash is not responsible for resolving such disputes and will not intervene except where required by law or court order.

Primary human account deletion

If the primary human deletes their account, linked humans will be notified and given 30 days to assume primary ownership of the dog profile. If no linked human assumes primary ownership within that period, the dog profile will be deleted in accordance with our Data Deletion policy.

5. Acceptable use

When using Offleash, you must not:

  • Harass, bully, threaten, intimidate, or engage in abusive behaviour toward any other user
  • Post false or misleading information about any dog, park, or user
  • Impersonate any person, dog, business, or organisation
  • Post content that is defamatory, offensive, obscene, or likely to cause serious harm to another person
  • Post content that is illegal under Australian law, including content that vilifies, incites violence, or facilitates criminal activity
  • Engage in unsolicited commercial solicitation or spam
  • Engage in any commercial activity through Offleash without a business account (see Section 14)
  • Attempt to access, scrape, or extract data from the Service by automated means without our prior written consent
  • Attempt to circumvent any security, access control, or age verification measure within the Service
  • Use the Service in any way that could damage, overburden, or impair the platform or its infrastructure

Park and dog safety

Park safety is your responsibility at all times. Offleash provides information and facilitates connections between dog owners but has no control over what occurs at parks or community meetups. You are responsible for your dog's behaviour at all times, including compliance with local council laws regarding leash requirements, dog registration, and park rules.

6. Your content

Ownership

You retain ownership of all photos, posts, comments, and other content you submit to the Service (“Your Content”). These Terms do not transfer ownership of Your Content to us.

Licence to Offleash

By submitting content to the Service, you grant CEDR Consulting Pty Ltd a non-exclusive, royalty-free, worldwide licence to display, reproduce, distribute, and make Your Content available within the Service for the purpose of operating and providing the Service to other users. This licence ends when Your Content is deleted, except where it has been incorporated into aggregated or anonymised data that cannot be linked back to you, in which case that derived data may be retained.

We will not use Your Content for purposes outside the operation of the Service — including advertising, licensing to third parties, or AI model training — without your explicit consent.

Your warranties

By submitting content, you warrant that:

  • You own the content or have the right to submit it
  • The content does not infringe the intellectual property rights of any third party
  • The content does not contain the personal information of any person without their consent
  • Photos of dogs have been taken by you or with the permission of the photographer

Content in groups and shared spaces

When you post content to a park group, that content becomes part of a shared community space. If you delete your account, your posts and photos in group feeds will have your authorship anonymised (shown as “A former member”) rather than being deleted, in order to preserve the continuity of community conversations. Your authorship attribution will be removed and the content will no longer be linked to your identity.

7. Park data and user-contributed corrections

Park data on Offleash is sourced from OpenStreetMap, council open data, and user-submitted corrections. Park information — including off-leash status, permitted hours, and amenities — may be incomplete, inaccurate, or out of date. Off-leash rules and park conditions can change at any time without notice to us.

You must always verify current off-leash rules and park conditions directly with the relevant local council before visiting a park.

By submitting a correction or update to park data (“park contribution”), you:

  • Grant Offleash a perpetual, irrevocable, royalty-free licence to use, display, and incorporate that information into the Service
  • Warrant that the information is accurate to the best of your knowledge
  • Acknowledge that Offleash may review, modify, or decline to publish any park contribution

Offleash is not liable for any loss, fine, injury, or other harm arising from reliance on park information in the Service, whether sourced from official data or user contributions.

8. Content moderation

Prohibited content

The following categories of content are prohibited on Offleash:

  • Content that harasses, threatens, or abuses any individual
  • Content that is sexually explicit or pornographic
  • Content that depicts or encourages animal abuse or cruelty
  • Content that contains graphic violence or gore
  • Spam, pyramid schemes, or unsolicited commercial messages
  • Misinformation about park conditions, dog health risks, or community health alerts that could cause harm
  • Content that vilifies or incites hatred toward any person or group
  • Content that facilitates or encourages illegal activity
  • Content that reproduces another person's personal information without their consent

Reporting

If you encounter content that violates these Terms or our Community Guidelines, you can report it using the in-app report function or by emailing hello@off-leash.app. Please include a description of the content, its location in the app, and the reason for your report.

Moderation process

We will review reports within 5 business days. Depending on the severity and nature of the reported content, we may:

  • Remove the content
  • Issue a warning to the user who posted it
  • Temporarily suspend the account
  • Permanently terminate the account
  • Refer the matter to law enforcement where required by law or where we believe there is a risk of serious harm

We are not obligated to monitor all content posted to the Service, and we are not liable for content posted by users that we have not yet reviewed. However, once we become aware of content that violates these Terms, we will take appropriate action. We reserve the right to remove any content and suspend or terminate any account at our discretion, including where we believe content is harmful even if it does not clearly fall within a prohibited category listed above.

9. Intellectual property — infringement claims

We respect intellectual property rights and expect users to do the same. If you believe that content on Offleash infringes your copyright or other intellectual property rights, please contact us at hello@off-leash.app with:

  • Your name and contact details
  • A description of the work you believe has been infringed
  • A description of the content on Offleash you believe is infringing, including its location in the app
  • A statement that you have a good faith belief that the use is not authorised by the rights holder
  • A statement that the information you have provided is accurate

We will investigate reports promptly and take appropriate action, which may include removing the content. Repeat infringers will have their accounts terminated.

10. Third-party services and links

The Service may contain links to external websites, services, or third-party content. We are not responsible for the content, accuracy, privacy practices, or availability of any third-party service. Linking to an external service does not imply our endorsement of it.

If you choose to access third-party services through the Service — for example, a business listed in a future business directory — you do so at your own risk and subject to the terms of that third party.

11. Health information and no veterinary advice

Nothing on Offleash — including content posted by users, information displayed in the Service, dog DMs, park data, weather advisories, or breed-specific guidance — constitutes veterinary advice. Dog DMs are generated for entertainment purposes only and do not reflect the health or wellbeing of your dog.

Vaccination status, health conditions, and other health information on dog profiles is self-reported by owners and is not verified by Offleash. Do not rely on dog profile health information when introducing your dog to others or assessing health risks.

Always consult a registered veterinarian for any health concerns about your dog.

12. Limitation of liability

Offleash is a technology platform. We facilitate connections between dog owners and provide park information. We are not an organiser of events or meetups, and we do not vet, endorse, vouch for, or make representations about any user, dog, or park listed on the Service.

Park visits and community meetups

Users participate in park visits and any community meetups organised through the Service entirely at their own risk. Offleash is not present at parks and has no control over what occurs there. We are not responsible for any injury, property damage, illness, incident, fine, or other harm arising from visits to parks or interactions with other users or dogs encountered through the Service.

General liability cap

To the maximum extent permitted by applicable law, Offleash's total liability to you for any claim arising from or related to the Service — whether in contract, tort, statute, or otherwise — is limited to AUD $100, or the total amount you have paid to us in the 12 months preceding the claim, whichever is greater. For users who have not paid any fees (which is all individual users at launch), this cap is AUD $100.

We are not liable for any indirect, incidental, special, consequential, or punitive loss — including loss of data, loss of revenue, or loss of profits — arising from your use of the Service.

Australian Consumer Law

Nothing in these Terms limits any right you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). Our services come with guarantees under the ACL that cannot be excluded. Where the ACL applies, our liability is limited to the extent permitted by law, including by re-supplying the relevant service or paying the cost of having the service re-supplied.

13. Dispute resolution

Step 1 — Contact us first

If you have a complaint or dispute arising from these Terms or your use of the Service, please contact us first at hello@off-leash.app. Describe your concern in as much detail as possible. We will acknowledge your complaint within 5 business days and aim to resolve it within 30 days.

Step 2 — Mediation

If we are unable to resolve the dispute within 30 days, either party may request mediation before a mutually agreed mediator. The costs of mediation will be shared equally unless otherwise agreed.

Step 3 — Litigation

If mediation does not resolve the dispute, either party may pursue the matter through the courts. These Terms are governed by the laws of Victoria, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Victoria for the resolution of any dispute. Nothing in this clause prevents either party from seeking urgent injunctive or interlocutory relief from a court of competent jurisdiction.

14. Business accounts

Business accounts — for groomers, veterinary clinics, dog trainers, daycares, pet stores, and similar businesses — will be available in a future release. Individual users may not use Offleash for commercial purposes without a business account. Separate Business Account Terms will be published when the business account feature launches and will govern the use of business accounts, including applicable fees.

15. Termination

By you

You may delete your account at any time from Settings. Deletion removes your personal data in accordance with our Data Deletion policy.

By us

We may suspend or terminate your account, with or without prior notice, if:

  • You breach these Terms
  • We reasonably believe your account has been compromised or is being used fraudulently
  • We are required to do so by law
  • We decide to discontinue the Service

Where practical, we will give you notice before termination and an opportunity to respond, except where immediate action is necessary to protect the safety of users or the integrity of the Service.

Effect of termination

Termination does not affect any rights or obligations that accrued before the termination date. Sections 6, 7, 9, 11, 12, and 13 of these Terms survive termination.

16. General

Entire agreement: These Terms, together with our Privacy Policy, Disclaimer, and any other policies incorporated by reference, constitute the entire agreement between you and CEDR Consulting Pty Ltd dba Offleash in relation to the Service.

Severability: If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

No waiver: Our failure to enforce any provision of these Terms on a particular occasion does not constitute a waiver of our right to enforce it on a future occasion.

Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations — for example, in connection with a business transfer — subject to the obligations described in our Privacy Policy.
